3. Quotations and Scope of Work
All quotations are provided in South African Rand and are valid for 30 days from the date of issue unless stated otherwise. Each project is defined by an agreed scope of work. Any work requested outside the agreed scope may be subject to additional charges, which will be communicated and approved before proceeding. Timelines provided are estimates and depend on the timely supply of content, feedback and approvals by the Client.
4. Payments and Deposits
Unless otherwise agreed in writing, a deposit is required before work commences, with the balance payable on completion or according to an agreed payment schedule. Ongoing services such as hosting, SEO and maintenance are billed on a recurring basis. Invoices are payable within the period stated on the invoice. We reserve the right to suspend Services or withhold Deliverables where payment is overdue.
5. Client Responsibilities
- Provide accurate, lawful content, text, images and materials in a timely manner.
- Ensure you hold the necessary rights and licences for any material you supply to us.
- Review and respond to drafts, proofs and approval requests within a reasonable time.
- Keep login credentials, hosting and domain information secure.
Delays caused by the Client in supplying materials or approvals may affect project timelines and are not the responsibility of Web Design Experts South Africa.
6. Intellectual Property
Ownership of the final Deliverables transfers to the Client upon full and final payment. Until payment is received in full, all work remains the property of Web Design Experts South Africa. We retain the right to reuse underlying code, frameworks, techniques and know-how, and to display completed work in our portfolio and marketing unless you request otherwise in writing. Any third-party assets, fonts, plugins or stock media remain subject to their respective licences.
7. Revisions and Approvals
A reasonable number of revision rounds is included in each project as agreed in the scope of work. Additional revisions beyond the agreed allowance may incur further charges. Once a Deliverable has been approved by the Client, subsequent changes are treated as new work.
8. Third-Party Services
Our Services may rely on third-party platforms such as domain registrars, hosting providers, payment gateways and analytics tools. We are not responsible for the availability, performance or policies of these third parties, and their use may be subject to their own terms.
9. Warranties and Disclaimers
We take reasonable care to provide Services professionally and to a high standard. However, we do not warrant that a website will be uninterrupted, error-free, or that specific search engine rankings, traffic or business results will be achieved, as these depend on factors beyond our control. The Website and its content are provided on an "as is" basis without warranties of any kind, express or implied, to the maximum extent permitted by South African law.
10. Limitation of Liability
To the fullest extent permitted by law, Web Design Experts South Africa shall not be liable for any indirect, incidental or consequential loss, including loss of profit, data or business, arising from the use of our Services or Website. Our total liability for any claim shall not exceed the amount paid by the Client for the specific Service giving rise to the claim.
11. Cancellation and Refunds
Either party may terminate a project by written notice. Where a project is cancelled by the Client, deposits and payments for work already completed are non-refundable, and any outstanding fees for work performed up to the cancellation date remain payable. Recurring services may be cancelled subject to the notice period stated in your agreement.
12. Confidentiality and Data Protection

13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts. We encourage clients to contact us first so that we may resolve any concern amicably.
